Application of these terms
These terms and conditions, which incorporate our Privacy Policy, apply to bookings made with Amoy Property Management Limited or its affiliates for the AMOY Home (“we”, “us” or “our”) and the use of the www.amoyhome.co.nz website, including any products, services, content or functionality available using that website (the “website”). By booking with us or otherwise using the website you agree to be bound by these terms.
1. Purchasing from the website
1.1 To place a booking with us you must be at least [18] years of age. The maximum number of staying guests per room is illustrated in the room occupancy details on the website. By making a booking, you agree to adhere to this number and to otherwise be responsible for cancellation, non-arrival and damages on the terms below. Only named booking party/parties are allowed to use the property and its facilities, any third-party visitors are only allowed access at our express permission.
1.2 You agree to use this Website for lawful purposes only and in a manner that does not violate any applicable laws or regulations.
1.3 We may, at our discretion, modify, suspend, or terminate the Website’s operation at any time without notice.
1.4 To secure any booking we require valid credit card details at the time of reservation. All room rates and charges on our site are in New Zealand dollars (NZ$) and include New Zealand GST (if any).
2. Payment
Payment is to be made by credit card. The functionality of our online payment facility is for your convenience only and you use it at your own risk. Information transmitted over the internet is never entirely secure. We take reasonable measures to protect your payment information (e.g., all transactions are processed using a secure online payment facility), however you are responsible for ensuring your computer is free from viruses or other forms of corruption. We are not responsible or liable for any unauthorised access or interference with any of your payments.
We may deduct any amounts you owe us from any credit or debit card information you provide us.
3. Check-in & Check-out
- Check-in is available from 3pm on the day of arrival (earlier check-in may be arranged in advance and is subject to availability)
- Check-out by: 10am on day of departure (late check-out may be arranged in advance and is subject to availability)
4. Cancellation, Non-Arrival and Early Departure Conditions
4.1 Cancellations are to be received in writing via email to info@amoyhome.co.nz
Your booking shall be deemed non-refundable in the event of the below:
- For individual bookings
Bookings outside 24 hours of arrival – Free Cancellation
Bookings within 24 hours of arrival – 100% charge of all rooms booked
- For group bookings – A minimum of 5 rooms are classes as a group booking.
Bookings outside 7 days – Free Cancellation
Between 7 days and 1 day to arrival – 50% charge of all rooms booked
Bookings within 24 hours of arrival – 100% charge of all rooms booked
4.2 Non-arrival
Non-arrival guests, who are unable to attend or fail to attend for whatever reason forfeit the full amount of the booking, unless cancelled in accordance with the timeframes above.
In the rare event we need to cancel your booking with us, please be aware that we cannot be held liable for circumstances beyond our control and that our liability to you is limited to the refund of any payment already made.
5. Wi-Fi Fair & Appropriate Usage Policy
Where Wi-Fi Internet access is provided, guests accept to use this access to the Internet fairly and appropriately. We may monitor network performance and user usage in order to maintain a fair and high level of service to all our guests.
The Internet access provided is intended for general use such as access to the world wide web, email, messaging, social media, light video / music / media streaming. It is not intended or ideally suited for heavy media streaming, online gaming, extensive downloads / uploads. Access to illegal activity or use of our network for illegal activity is prohibited and will be reported to local authorities.
6. Damages & Lost Property
We reserve the right to charge you for any damages caused through the course of a booking by any member of the booking party. This includes breakages, spillages, stains, damage to furniture or fixtures and fittings. Any accidental damages should be reported as soon as possible in order to minimize damage and associated costs.
Any lost property, if discovered and found, left behind by guests during a stay will be held for a period of 1 month. While we will make our best efforts to reunite lost property with their owners at the owner’s cost, we accept no responsibility in replacing lost items or related costs. Any perishable items that are left behind will be disposed of immediately.
7. Liability
To the extent permitted by law, we exclude all liability for loss or damage to any of your property during your stay with us. To the extent we cannot exclude our liability at law, our liability is limited to a maximum of $200. Please ensure all doors and windows are locked, and personal items secured, when you are not in your room.
8. Unaccompanied Minors
Any person under the age of 18 must be accompanied in the room at all times by an adult over the age of 18.
9. Our rooms are all 100% non-smoking/vaping
Smoking/vaping in any room on the motel property is prohibited. Should you be found smoking/vaping in any room on the motel property, we may issue fines or require you to be evicted without refund. There are options to smoke/vape outdoors away from any rooms and we ask that you use the ashtrays provided to dispose of your waste thoughtfully.
10.Pets & Service Dogs
We do not accept pets throughout the accommodation, except for service dogs.
11.Quiet Enjoyment
All guests agree to respect the privacy and peace of all other staying guests, neighbours and the owners at all times. We reserve the right to cancel a booking with immediate effect if guests are not honouring this agreement or causing a disturbance / nuisance to other guests, neighbours or the owners.
12.Your Personal Details & Privacy
Our policy surrounding the personal details you provide as part of any booking or enquiry through this website / or third-party website, including the privacy of those details are explained and set out in our Privacy Policy.
We may collect, hold, use and disclose your personal information (including the personal information that you provide to us and that we obtain from third parties) for a number of purposes detailed in our Privacy Policy. For example:
- managing your hotel bookings;
- collecting information about you (for example, your booking history) along with information in the public domain to improve or tailor services offered to you;
- for statistical analysis, sales and marketing research and for business improvement analysis;
- sending you marketing material about products and services we believe are suited to you and your interests. If you do not wish to receive any of this material you may simply choose “unsubscribe” from our mailing list and no further material will be sent to you;
- otherwise, to lawfully conduct and develop our business, and
- any other use that you authorize.
and you consent to the collection, use and disclosure for those purposes and any reasonable related purpose.
13. Our Right to Cancellation
We reserve the right to cancel any booking without compensation, refund or reimbursement if these terms and conditions are breached.
14.User Content
14.1. You may be allowed to submit or post content to our website, including comments, reviews, and other materials (“User Content”). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your User Content.
14.2. You are solely responsible for the content you submit, and it must not violate any third-party rights or applicable laws. We reserve the right to remove or modify User Content at our discretion.
15.Intellectual Property
15.1. The content, design, and all materials on this Website, including but not limited to text, graphics, logos, images, and software, are protected by copyright and other intellectual property rights owned by the Company.
15.2. You may not reproduce, distribute, display, or create derivative works of any content on this Website without our prior written consent.
16.General Changes
We may revise these terms of use at any time (with immediate effect) by amending this page and will not be required to notify you of any such change. Some of the provisions contained in these terms of use may also be superseded by provisions or notice published elsewhere on the website.
17.Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use or inability to use the Website, (b) any unauthorized access to or use of our servers and/or any personal information stored therein, (c) any interruption or cessation of transmission to or from the Website, (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Website by any third party, or (e) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Website, whether based on warranty, contract, tort, or any other legal theory, and whether or not the Company is advised of the possibility of such damages.
18.Severability
If any part of these terms is held by any court or administrative body of competent jurisdiction to be illegal, void or unenforceable, such determination will not impair the enforceability of the remaining parts of these terms.
19.Jurisdiction
These Terms are governed by and construed in accordance with the laws of New Zealand courts. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Website shall be brought exclusively in the courts located in New Zealand courts, and you consent to the personal jurisdiction of such courts.
